Terms of Service

1. Acceptance of Terms
By creating an account, downloading the mobile application, or using any part of the ATBot platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). ATBot is developed and operated by Alfatonics, a technology company registered in Dar es Salaam, Tanzania.
If you are using ATBot on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
ATBot provides the following services to businesses:
- AI Chatbot: Automated customer engagement via WhatsApp and Instagram using artificial intelligence.
- CRM: Contact management, sales pipeline, and conversation tracking.
- Meta Ads Builder: Create and manage Facebook and Instagram advertising campaigns.
- Broadcast Messaging: Send bulk WhatsApp template messages to your contacts.
- Product Catalog: Manage and showcase your products and services.
- Team Management: Invite team members with role-based access control.
- Analytics: Business performance dashboards and reporting.
3. Account Registration
- You must provide accurate and complete information during registration.
- You may register using email/password, Facebook Login, Google Sign-In, or Apple Sign-In.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to create an account.
- One primary account per business is permitted. Team members may be invited under the owner's account.
- You must promptly notify us of any unauthorized use of your account.
4. Free Trial and Subscriptions
- New accounts receive a free trial period (duration set by Alfatonics, typically 14 days).
- During the trial, you have access to all features of the Service.
- After the trial expires, you must subscribe to a paid plan (Starter, Growth, or Pro) to continue using premium features.
- Payments are processed via mobile money (M-Pesa, Airtel Money, Tigo Pesa) through our payment partners.
- Subscriptions are billed monthly. You may cancel at any time — access continues until the end of the billing period.
- Prices are displayed in Tanzanian Shillings (TZS) and may be updated with 30 days' advance notice.
- Promotional codes may provide discounts or trial extensions and are subject to their own terms.
5. Acceptable Use
You agree not to:
- Send spam, unsolicited messages, or bulk messaging that violates WhatsApp/Meta policies.
- Use the Service for any illegal, fraudulent, or harmful activities.
- Attempt to access other users' accounts or data.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use automated tools to scrape, mine, or exploit the Service.
- Upload malicious content, viruses, or harmful code.
- Impersonate any person or entity.
- Violate any applicable local, national, or international law or regulation.
Violation of these terms may result in immediate account suspension or termination.
6. Third-Party Services
ATBot integrates with the following third-party services. By using these integrations, you also agree to their respective terms:
- Meta Platforms: WhatsApp Business API, Instagram Messaging, Facebook Ads. Subject to Meta's Terms of Service.
- Google: Google Sign-In for authentication. Subject to Google's Terms of Service.
- Apple: Apple Sign-In for authentication on iOS. Subject to Apple's Terms.
- AI Providers: OpenAI and Google for AI-powered chatbot responses.
You may disconnect any third-party service at any time via your account settings or the provider's settings page. ATBot is not responsible for the availability or performance of third-party services.
7. AI Chatbot Disclaimer
ATBot uses artificial intelligence to generate automated responses to your customers. Please note:
- AI responses may not always be accurate or appropriate for every situation.
- You are solely responsible for all communications sent to your customers, including AI-generated messages.
- You should regularly review AI responses and adjust your knowledge base and settings as needed.
- ATBot provides tools to pause AI auto-reply for specific conversations when human intervention is needed.
8. Intellectual Property
- The ATBot platform, including its design, code, features, and branding, is the intellectual property of Alfatonics.
- You retain ownership of all content you upload to the Service (products, messages, images, knowledge base).
- By using the Service, you grant Alfatonics a limited license to process your content solely for the purpose of providing the Service.
9. Service Availability
- We strive for 99.9% uptime but do not guarantee uninterrupted service.
- Scheduled maintenance will be communicated in advance when possible.
- ATBot is not liable for downtime caused by third-party services (Meta, payment providers, hosting infrastructure).
10. Account Suspension and Termination
- We may suspend or terminate your account if you violate these Terms.
- You will receive notice before suspension except in cases of serious or repeated violations.
- You may delete your account at any time by contacting us at hello@alfatonics.com.
- Upon termination, your data will be retained for 30 days before permanent deletion, unless retention is required by law.
11. Limitation of Liability
To the maximum extent permitted by law:
- ATBot is provided "as is" without warranties of any kind, express or implied.
- Alfatonics is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
- Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
- We are not responsible for any losses resulting from AI-generated content, third-party service failures, or actions of your team members.
12. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania. Any disputes shall be resolved through negotiations first, and if necessary, through the courts of Dar es Salaam, Tanzania.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
